Terms of Service

1. Purpose

VYVE is a small-group live video service: a creator offers a session at a given time, with a limited number of paid seats that users ("viewers") book individually. All sessions are paid. The service is available at https://www.vyve-live.com; a mobile app may be offered later. These Terms of Service govern access to and use of the service. By creating an account, you accept these Terms.

2. Publisher

3. Minimum age

You must be at least 16 years old to use VYVE. By creating an account you certify that you meet this requirement.

4. Account

You are responsible for the accuracy of your information and the confidentiality of your credentials, and for all activity under your account. One account per person, and one username per account: it is unique across the service and cannot be shared. Sign-in is available via email/password or a third-party identity provider (e.g. Google).

5. Code of conduct

Strictly prohibited: illegal, hateful, violent content; any sexual content involving minors; harassment; impersonation; infringement of others’ intellectual property; spam; fraud; circumventing payments. Violations may result in suspension or deletion of the account without notice or refund.

6. Creator content

Creators undertake to hold their session regardless of how many seats were sold, even if only one person booked. The seat count is an upper limit, never a target to reach: someone who paid is entitled to their live. Cancelling a session because it is not full enough breaches these Terms and may lead to frozen payouts or account suspension. Creators are also bound by the announced schedule. Once the start time is reached, the title, price, duration, seat count and date are frozen: they can no longer be changed, because people booked on that basis. Creators are solely responsible for the content they broadcast. VYVE is not the author of such content and acts as a hosting provider under applicable regulations. VYVE may remove content, block a creator, or freeze their payouts upon report or violation.

7. Content reporting and moderation

Any user may report content or an account they consider unlawful or contrary to these Terms, directly in the service ("Report" button on profiles and sessions) or by email to belhamouariel@icloud.com, describing precisely the content concerned and the reasons. Reports are reviewed promptly and may result in content removal, account suspension or payout freeze. Some measures are automatic: when the same live is reported by several viewers who actually booked a seat, it is cut immediately and the room is closed for everyone, the creator included, with no prior human review. Affected viewers are refunded in full. The decision is reviewed afterwards and the creator may contest it. You can also block Recording by viewers is prohibited. Recording, filming or screen-capturing a live and then redistributing or sharing it breaches these terms and the creator's rights. A browser cannot technically block recording, so a viewer identifier is embedded in the image, meaning any circulated copy can be traced back to the account that captured it. Breaches may lead to account suspension and legal action.

Live schedule

Entry closes at the announced end time (start time plus the stated duration), for everyone including the creator: past that point nobody joins the room. People already connected may stay if the live runs over. A creator who starts late does not push back the end time they sold.

What happens during a live

Public chat is open to everyone present. Two features depend on a creator setting, which they can turn on or off at any time: private chat, letting a viewer message them directly during the session; photo sending by viewers, in the public chat as well as in private. A viewer may ask to speak; the creator accepts or declines. Images exchanged during a live are only accessible to people with access to that live, and are never public. Anything posted in a live — text or image — remains subject to section 5 and can be reported.a user to stop seeing their content. If you believe a moderation decision affecting you is unjustified, you may contest it by writing to belhamouariel@icloud.com; your complaint will be re-examined. 8. Lives: a one-off moment, never recorded

Sessions are not recorded and there are no replays. A VYVE live happens once, in real time: what you did not watch live is kept nowhere. By joining a live, you consent to your appearance (image, voice, chat messages) to the other participants present, and to them alone.

9. Payments

Paid sessions are processed via our payment provider Stripe Payments Europe, Ltd.. See the Sales Terms for pricing, payment and refunds.

10. Intellectual property

The VYVE brand, logo, design and service code are protected. You keep your rights to the content you post but grant VYVE a non-exclusive, royalty-free license to host and display it as part of the service.

11. Availability

The service is provided "as is". We do not guarantee uninterrupted availability and may modify or discontinue all or part of the service.

12. Suspension and termination

You may delete your account at any time in Settings. We may suspend or terminate an account for violations of these Terms.

13. Limitation of liability

To the extent permitted by law, VYVE shall not be liable for indirect damages arising from use of the service or from the conduct of any creator or viewer.

14. Changes

These Terms may change. Material changes will be notified to you. Continued use constitutes acceptance.

15. Governing law and mediation

These Terms are governed by the laws of France, subject to mandatory provisions applicable in your country of residence. For consumer disputes, see the "Consumer mediation" section of the Sales Terms.
