These Sales Terms apply to purchasing access to paid sessions on VYVE (website https://www.vyve-live.com). Seller: Ariel Belhamou — see the Legal Notice.
2. Prices
Prices are shown in euros, including tax where applicable, and set by each creator. The price shown at order time is what you are charged.
3. Payment
Payment is processed via Stripe Payments Europe, Ltd.. VYVE collects the payment and then pays the creator their share, minus a service commission of 30%. A payment receipt is emailed to you by our payment provider.
3 bis. Tips
After a session you attended, you may leave a tip for the creator (€2, €5 or €10), for 48 hours after the live ends. A tip is voluntary: it grants no access, no advantage and no additional content.
VYVE takes a 40% service commission on tips; the creator receives 60%. This rate is separate from the one applied to seats and applies to every creator.
Because a tip is a voluntary payment with no consideration in return, it is not refundable, except in case of fraudulent payment or a technical error attributable to VYVE.
4. Access to the session
After confirmed payment, your seat appears in "My tickets" (Logbook in the app). Live access opens shortly before start time.
The session goes ahead even if the seats do not all sell: your seat entitles you to the live, including if you are the only participant. A creator may not cancel because too few people booked. Should it happen anyway, you are refunded in full (section 6).
5. Right of withdrawal
A live session is a leisure service supplied at a specific date: under Article L221-28, 12° of the French Consumer Code, the 14-day right of withdrawal does not apply to booking a dated session. Our more favourable cancellation policy in section 6 still applies.
6. Cancellation and refunds
You are fully refunded if: (a) the session is cancelled by the creator, (b) the creator does not show up, or (c) you cancel before the session starts. No refund is due after the session has actually taken place, except for a major technical issue attributable to VYVE. Refunds are processed via Stripe Payments Europe, Ltd. to the original payment method.
If the creator cancels, you choose. VYVE offers either a full refund or a free seat for a future live, as you prefer. That seat is valid for 3 months on a session by the creator who cancelled; after that it can be used with any creator on the platform, on a session priced no higher than what you paid. It remains valid for 12 months in total from the cancellation.
A refund remains your right and the default option: accepting a seat is optional, and you can request the refund at any time as long as the seat has not been used. If you make no choice within 14 days, you are refunded automatically.
7. Creators — payout of earnings
VYVE collects all payments and pays each creator their share (70%) on a reasonable schedule, after a short safety delay following the end of the live, and from €15 accumulated. VYVE may withhold, freeze or claw back amounts in case of fraud, dispute, viewer refund or breach of the Terms. Each creator is solely responsible for their tax and social obligations; as a platform operator, VYVE may be required to report creators’ income to tax authorities ("DAC7").
8. Complaints
If there is a problem with an order, contact belhamouariel@icloud.com first: most situations are resolved at this stage, before any bank chargeback.
9. Consumer mediation
In accordance with Articles L611-1 et seq. of the French Consumer Code, any consumer has the right to free recourse to a consumer mediator for the amicable resolution of a dispute with a professional, after a prior written complaint has failed.
Designated mediator: L’adhésion à un médiateur de la consommation sera effective avant l’ouverture des paiements au public ; ses coordonnées seront publiées ici à ce moment. En phase d’avant-première, aucune vente n’est ouverte au grand public.

10. Governing law
These Terms are governed by the laws of France, without prejudice to mandatory provisions of the consumer’s country of residence.
